This paper posits a feminist aesthetic of reading, ‘re-captivation,’ which accounts for both the reader's pleasure and his/her ethical responsibility. Re-captivation is distinguished by its introspective and ethical characteristics; it is a pleasure informed by the pain of misrecognition, i.e. acknowledgement of one's own complicity in systems of oppression. After a brief explanation of re-captivation, this paper describes my experience viewing the film Menace II Society. In 1988, Colorado instituted a new regulatory system that was opposed by psychologists and social workers. We surveyed 306 psychotherapists about their attitudes regarding this system, which included profession-specific licensing boards and an omnibus board to handle grievances. Social workers and psychologists, members of more established professions, opposed creating an omnibus licensing board and favored the return of profession-specific grievance functions. Members of the newer professions and unlicensed psychotherapists were not as opposed to omnibus boards. All groups agreed in their (...) positive ratings of the performance of the Colorado grievance structure. These results are discussed in terms of "capture" theory, which postulates that professions capture governmental regulation and use it for their own interests. (shrink)

Insight experiences are sudden, persuasive, and can accompany valuable new ideas in science and art. In this preregistered experiment, we aim to validate a novel visceral and continuous measure of insight problem solving and to test whether real-time and embodied feelings of insight can predict correct solutions. We report several findings. Consistent with recent work, we find a strong positive relationship between Aha moments and accuracy for problems that demand implicit processing. We also found that the intensity of the insight (...) experience further predicted the accuracy of solutions and participants naturally embodied the intensity of their insight experiences by squeezing the dynamometer more tightly. Intriguingly, this unintentional embodiment further predicted the accuracy of solutions. We suggest that the dynamometer complements previous measures by (1) simultaneously capturing both process and feeling in real-time, (2) highlights the value of measuring Aha moments on a continuum of intensity, and (3) firmly establishes that the impulsive feeling of Aha can carry information about the veracity of an idea. We discuss the findings in light of a recent theoretical account of how feelings of insight may act as a heuristic to select ideas from the stream of consciousness. (shrink)

Concerns for safety and security as South Africa’s hosting of 2010 FIFA World Cup draws nearer highlight the degree to which South Africa’s reputation for a relatively peaceful transition from Apartheid has been replaced by its reputation for violent crime. Its transition, and the peacebuilding efforts that followed it, are not completely unrelated to its current high levels of violent crime. In fact, this article argues that there were a number of issues South Africa’s peacebuilding process failed to address that (...) are relevant to the country’s violent crime situation. A significant reason for this failure was an inability or unwillingness to engage the full spectrum of Apartheid’s violence with equal rigour. Apartheid inflicted structural violence, through its racially oppressive laws, as well as physical violence, through enforcing its laws and suppressing its opposition, on the people of South Africa. Peacebuilding in South Africa primarily focused on Apartheid’s physical violence. Through the work of the Truth and Reconciliation Commission, the focus was narrowed down further to physical political violence. Due to this narrow focus, it did not attend effectively to non-political violence – which includes gender-based violence, the esteem violence had attained during and due to Apartheid, disarming the country of illegal firearms, and narrowing the income gap between the country’s rich and poor. While South Africa proudly claims ownership of its conflict resolution and peacebuilding processes, it still emulated predominant models of building peace through liberal democracy and a market economy. These models have been drawn from Western success stories in diminishing interstate conflict, while South Africa is a developing country that was recovering from an intrastate conflict. Pursuing these models has had benefits for South Africa, but not in many of the ways it needed in order to effectively prevent a surge in criminal violence in the wake of Apartheid. (shrink)

False “Aha!” moments can be elicited experimentally using the False Insight Anagram Task (FIAT), which combines semantic priming and visual similarity manipulations to lead participants into having “Aha!” moments for incorrect anagram solutions. In a preregistered experiment (N = 255), we tested whether warning participants and explaining to them exactly how they were being deceived, would reduce their susceptibility to false insights. We found that simple warnings did not reduce the incidence of false insights. On the other hand, participants who (...) were given a detailed explanation of the methods used to deceive them experienced a small reduction in false insights compared to participants given no warning at all. Our findings suggest that the FIAT elicits a robust false insight effect that is hard to overcome, demonstrating the persuasive nature of false insights when the conditions are ripe for them. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

The devastating toll of gun violence has given rise to hundreds of lawsuits seeking justice on behalf of victims and their families. A significant number of challenges against gun companies, however, are blocked by courts' broad reading of the Protection of Lawful Commerce in Arms Act — a federal statute often interpreted to shield the gun industry from civil liability. This article reexamines PLCAA in light of the Supreme Court's recent federalism caselaw, which counsels courts to narrowly construe federal laws (...) that could otherwise upset the balance of power between states and the federal government. Since PLCAA infringes on traditional areas of state authority, the Supreme Court's federalism jurisprudence requires lower courts to interpret PLCAA narrowly, to not bar states from imposing negligence, nuisance, product liability, or other common law liability on gun companies. Reading PLCAA in line with federalism principles would preserve states' traditional authority over their civil justice laws, and enable gun violence victims, and their families, to hold gun companies responsible for wrongdoing. Professionals in environmental fields engage with complex problems that involve stakeholders with different values, different forms of knowledge, and contentious decisions. There is increasing recognition of the need to train graduate students in interdisciplinary environmental science programs in these issues, which we refer to as “social ethics.” A literature review revealed topics and skills that should be included in such training, as well as potential challenges and barriers. From this review, we developed an online survey, which we administered to faculty (...) from 81 United States colleges and universities offering IESPs. Respondents overwhelmingly agreed that IESPs should address values in applying science to policy and management decisions. They also agreed that programs should engage students with issues related to norms of scientific practice. Agreement was slightly less strong that IESPs should train students in skills related to managing value conflicts among different stakeholders. The primary challenges to incorporating social ethics into the curriculum were related to the lack of materials and expertise for delivery, though challenges such as ethics being marginalized in relation to environmental science content were also prominent. Challenges related to students’ interest in ethics were considered less problematic. Respondents believed that social ethics are most effectively delivered when incorporated into existing courses, and they preferred case studies or problem-based learning for delivery. Student competence is generally not assessed, and respondents recognized a need for both curricular materials and assessment tools. (shrink)

Purpose Medical students receive a varying amount of training in medical ethics and are expected to navigate clinical ethical dilemmas innately. There is little literature on attempts to navigate ethical dilemmas experienced during early clinical experiences and whether current curricula prepare students for these dilemmas. This study explores the different ethical dilemmas experienced by medical students on their third-year clerkships and analyzes the factors, sources, and resolutions proposed by them.Methods From 2016 to 2018, third-year medical students completed a written assignment (...) to describe, analyze, and reflect on a clinical situation in which they experienced an ethical dilemma. They identified specific ethical dilemmas present, potential preventative and aftermath solutions, and reflected on their professional development from their experience. The research team utilized applied thematic analysis to identify themes and patterns in the data. A thematic matrix was utilized to examine similarities and differences across medical students.Results Of the 162 reflections, 144 (88.9%) students indicated an ethical dilemma that included issues related to autonomy and beneficence. Of these, 116 (71.6%) students found the two ethical principles in direct conflict. Students identified three common sources of this conflict: lack of communication; unclear understanding of clinical policies regarding family authority and psychiatric capacity; and medical negligence. Lastly, students suggested different solutions for dealing with and preventing this conflict.Conclusion Our findings suggest that an overwhelming number of students face ethical challenges when confronted with medical situations that raise conflicts between autonomy and beneficence. Their recommended solutions reveal an appeal among students to have tools and strategies in place to ease the need to make difficult decisions. Medical students might be better served by learning about the complexities of ethical decision-making and the likelihood of experiencing moral distress when they feel an inability to implement what they envision as the best solution. Is it possible to advance democracy by empowering ordinary citizens to make key decisions about the design of political institutions and policies? In 2004, the government of British Columbia embarked on a bold democratic experiment: it created an assembly of 160 near-randomly selected citizens to assess and redesign the province's electoral system. The British Columbia Citizens' Assembly represents the first time a citizen body has had the power to reform fundamental political institutions. It was an innovative gamble that has been (...) replicated elsewhere in Canada and in the Netherlands, and is gaining increasing attention in Europe as a democratic alternative for constitution-making and constitutional reform. In the USA, advocates view citizens' assemblies as a means for reforming referendum processes. This book investigates the citizens' assembly in British Columbia to test and refine key propositions of democratic theory and practice. (shrink)

A Philosopher Looks at Quantum Mechanics’ (Putnam [1965]) explained why the interpretation of quantum mechanics is a philosophical problem in detail, but with only the necessary minimum of technicalities, in the hope of making the difficulties intelligible to as wide an audience as possible. When I wrote it, I had not seen Bell ([1964]), nor (of course) had I seen Ghirardi et al. ([1986]). And I did not discuss the ‘Many Worlds’ interpretation. For all these reasons, I have decided to (...) make a similar attempt forty years later, taking account of additional interpretations and of our knowledge concerning non-locality. (The Quantum Logical interpretation proposed in Putnam [1968] is not considered in the present paper, however, because Putnam [1994b] concluded that it was unworkable.) Rather than advocate a particular interpretation, this paper classifies the possible kinds of interpretation, subject only to the constraints of a very broadly construed scientific realism. Section 7 does, however, argue that two sorts of interpretation—ones according to which a ‘collapse’ is brought about by the measurement (e.g. the traditional ‘Copenhagen’ interpretation), and the Many Worlds interpretation or interpretations—should be ruled out. The concluding section suggests some possible morals of a cosmological character. The move towards the use of new technologies and the new focus on citizen engagement in Scotland provides the opportunity for e-democracy to emerge. Working towards the goal of e-democracy, the International Teledemocracy Centre is developing a body of ICT, supporting skills, tools and techniques, designed specifically to facilitate the use of technology, capable of enhancing democratic engagement. This paper begins to articulate how citizens are engaging with government and with their elected representatives about issues that concern them, using technology (...) specially designed for the purpose. The paper examines the nature of e-democracy and considers concepts of democracy, issues of democratization, and issues surrounding citizen access and participation. In addition, the paper discusses the design and use of two electronic tools developed by the ITC between 1999 and 2001 i. e. e-consultant and e-petitioner. Finally, the paper presents analyses of findings drawn from research to monitor and evaluate the use of these tools and the arrangements which accompany their entry into society. (shrink)

Increasing genetic knowledge over the last decade has enabled hundreds of genetic variants associated with inherited cardiac conditions to be identified, many of which cause increased risk of sudden cardiac death. While individually these conditions are rare, taken together they impose a significant burden. The severity of these conditions—the possibility that they might cause sudden unheralded death of a teenager or young adult—juxtaposed with uncertainty about the pathology linked with many of the genetic variants is significant in terms of professional (...) practice because, increasingly, clinicians have been encouraged to cascade out genetic testing from the proband or consultand to other family members who may be at risk of developing the same condition. This process often involves sharing human tissue samples, DNA or personal information. This paper reviews the legal and regulatory frameworks which may apply when tissue and DNA samples are collected, used and retained, both for the purpose of diagnosis and for benefiting other family members, when a suspected or definitive diagnosis of an inherited cardiovascular condition is made. Sometimes the interests of family members may conflict, and it may be difficult for practitioners to reconcile the interests of one family member with another, particularly if the balance of benefits and harms from testing is unclear. The paper then examines some of the ethical tensions which may arise in practice and concludes that all involved should be conversant with the legal and ethical frameworks that apply. (shrink)

This article aims to analyze the fundamentals of Alain de Libera’s archeology of the subject. Two central thesis will be investigated here: Descartes arrived at his theory of the subject in a controversy with Hobbes and Regius, in order to avoid the reduction of the individual to bodily life and passivity; Thomas Aquinas and Peter John Olivi were responsible for a mature approach to the theme of the subject, which had been elaborated by Patristic authors, eminently by Augustine of Hippo, who formulated a comprehensive scheme of the self as support and agent. Studies of reasoning have often invoked a distinction between a natural or ordinary consideration of the premises, in which they are interpreted, and even distorted, in the light of empirical knowledge, and an analytic or logical consideration of the premises, in which they are analysed in a literal fashion for their logical implications. Two or three years of schooling have been seen as critical for the spontaneous use of analytic reasoning. In two experiments, however, 4-year-olds who were given brief instructions (...) that prompted use of an analytic approach continued to adopt this approach one week later. Thus, when given syllogistic problems in which the major premise was incongruent with their empirical knowledge (e.g. "All snow is black"), instructed children reasoned more accurately from that premise both immediately and a week later as compared to children given only a basic introduction. A third experiment showed that instructions also improved 4-year-olds' performance on hard-to-imagine, abstract material (e.g."All mib is white"). Similarities between the effects of brief instruction and of schooling are discussed. (shrink)

Secondo questa concezione, i giudizi fattuali, in quanto verificabili o falsificabili empiricamente, riguardano le aree di razionalità «pura» e omogenea e sono ancorati naturalisticamente al mondo. Gli enunciati di valore, invece, sarebbero da relegare nella sfera di ciò che è semplicemente «soggettivo», emotivo, irrazionale. Questo assunto, che ha dominato per molto tempo le scienze e la filosofia, è stato messo in dubbio dai pragmatisti e (...) da alcuni dei più influenti pensatori contemporanei, che, intervenendo al dibattito sull’oggettività dell’etica, hanno mostrato come la presunta eterogeneità tra giudizi descrittivi e giudizi valutativi sia ormai insostenibile. We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. There is a widespread assumption that the classical work in philosophical semantics of Saul Kripke (1980) and Hilary Putnam (1975) has taught us that the essences of natural kinds of substances, such as water and gold, are discoverable only a posteriori by scientific investigation. It is such investigation, thus, that has supposedly revealed to us that it is an essential property of water that it is composed of H2O molecules. This is the way in which Scott Soames, in a (...) recent paper, makes the point in the case of water and H2O: [Here is] how a Kripkean explanation of the necessary a posteriority of [‘Water = H2O’] would go – or at any rate my version of it. The account holds that ‘water’ is a non-descriptive, directly-referential term designating a substance – where substances are taken to be physically constitutive kinds (instances of which share the same basic physical constitution). It is further assumed that a kind of this sort may have different instances in different world-states, and that if a and b are kinds with the same instances in all possible world-states, then a is b. These are clearly metaphysical assumptions, to which we add the natural corollary that for any substance, s, if, in some possible world-state, instances of s have a certain molecular structure, then instances of s have that structure in every world-state. In other words, we assume that it is an essential property of a substance that instances of it have the molecular structure they do. From this it follows that [‘Water = H2O’] is necessary if true, and that ‘H2O’– which I take to be equivalent to ‘the substance instances of which have a molecular structure with two hydrogen atoms and one oxygen atom’– is a rigid designator. Being true, [‘Water = H2O’] is, therefore, necessary. Since knowing the proposition it expresses requires knowing of a certain substance that its instances have a particular chemical structure, [‘Water = H2O’] is knowable only a posteriori. La tecnología reproductiva alcanzó un nuevo récord en 2017 con el nacimiento de un infante de sexo femenino que se desarrolló dentro del útero de una donante fallecida. No se registraron complicaciones inusuales en el procedimiento ni en lo referente a la salud de la madre. Tres años antes, ensayos clínicos suecos señalan el nacimiento de dos infantes de sexo masculino provenientes de úteros extraídos de donantes vivas, vinculados a las madres. La ciencia había logrado curar el factor de infertilidad (...) uterino absoluto (AUFI por sus siglas en inglés), en mujeres con esta condición. Es importante que, si bien algunos ajustes en el procedimiento dominarán el desarrollo futuro, especialmente en los aspectos clínicos, no debemos olvidar las consideraciones éticas. Por lo anterior, esta revisión documental se centra en cómo se ven los trasplantes de útero de donantes fallecidas dentro de los datos disponibles en tres contextos principales: la antropología del ser humano, la medicina y la sociología, con énfasis en ciertas construcciones culturales de la sociedad liberal moderna. Subyacente al diagnóstico está el hecho de que el útero es un órgano no vital en la fisiología humana, y los trasplantes de útero de donantes fallecidas (DD UTX por sus siglas en inglés) plantean nuevos desafíos en la ética. En esta revisión se presentan los sesgos observados en los datos, las limitaciones de un procedimiento de menos de diez años y las conclusiones a las que llegamos. (shrink)

‘Water is H2O’ is one of the most frequently cited sentences in analytic philosophy, thanks to the seminal work of Saul Kripke and Hilary Putnam in the 1970s on the semantics of natural kind terms. Both of these philosophers owe an intellectual debt to the empiricist metaphysics of John Locke's Essay Concerning Human Understanding, while disagreeing profoundly with Locke about the reality of natural kinds. Locke employs an intriguing example involving water to support his view that kinds (or ‘species’), (...) such as water and gold, are the workmanship of the human mind. This is the point of his story about a winter visitor to England from Jamaica, who is astonished to find that the water in his basin has turned solid overnight, and proceeds to call it ‘hardened water’. Locke criticizes this judgement, maintaining that it is more consonant with common sense to regard water and ice as different kinds of substance. Putnam, by implication, disagrees. Deploying his imaginary example of Twin Earth—a distant planet where a watery-looking substance, XYZ, rather than H2O, fills the oceans and rivers—he maintains that common sense supports the judgement that XYZ and H2O, despite their superficial similarity, are not the same kind of substance, precisely because their molecular compositions are different. Here it will be argued that both views are mistaken, but that, in this dispute, Locke has more right on his side than his modern opponents do. (shrink)

Este artigo parte da afirmaçáo de Hilary Putnam feita no inicio do capItulo 6 -fato e valor do seu livro Razáo, verdade e historia, ou seja, a afirmaçáo de que tem do fato e valor, ao contraio de outras questões filosoficas como as relativas a a linguagem, a epistemologia ou mesmo a metafisica; e do interesse de todas a pessoas. Assim, objetivamos mostrar a posiçáo de Putnam frente a questáo fato e valor tambem conhecida por Sein (ser) e Solen (...) (Dever ser], procurando tecer algumas considerações a respeito do seu ponto de vista, pretendendo, por fim, mostrar que a ideia defendida por este filosofo é a de que náo existe uma separaçáo absoluta entre fato e valor. There is a paradox, or self-defeating supposition in the core of constructionism, for it would appear that any attempt to resolve a dispute in historical interpretation within a convention of self-contained criteria of confirmation by appealing to justificatory criteria outside the convention -to wit, the theory of constructionism -is self-defeating. Through the theoretical consideration of historians isolated in a vat, following Hilary Putnam's metaphor, it becomes clear that the vat language of the historians does not have the possibility of (...) referring, intrinsically or extrinsically, to anything external. The implications of the vat metaphor for an understanding of historical inquiry are: 1) we need to recognize and insist upon different levels of abstraction both in historical writing and in the justification of its claims; 2) applied to history, the set paradox reveals the need to recognize that at the most abstract level of consideration we encounter inescapable incoherence; and 3) we need to recognize that in some important sense reference must be completed in the world, regardless of the problems in characterizing this sense philosophically. A questão do relacionamento entre a normatividade e valoração e sua incorporação no discurso racional é um dos problemas mais relevantes na filosofia contemporânea e é claramente desdobrada em todas as suas complexidades no debate paradigmático mantido entre Hilary Putnam e Jürgen Habermas durante a primeira década do século XXI. A partir dessas posições que reivindicam a tradição do pragmatismo americano, os filósofos discutem a objetividade dos juízos de valor e normativos defendendo, com diferenças significativas, uma posição cognitivista. A (...) presente contribuição aborda essa discussão com o propósito de apresentar o pragmatismo conceitualista de Clarence Irving Lewis como uma alternativa e posição profícua com os recursos para interagir com algumas das principais questões discutidas por Putnam e Habermas. Meu propósito é mostrar o modo como Lewis explica o caráter cognitivo das normas e valores enquanto sustenta, simultaneamente, uma demarcação significativa entre ambos os conceitos. Argumentarei que essa distinção é pragmática – não epistêmica –, e que isso permite ao pragmatista defender um cognitivismo que pode articular um naturalismo não reducionista referente aos valores com um conceito racionalista de normas, uma posição que pode evitar algumas das objeções que enfrentam Putnam e Habermas. Alguns autores têm afirmado que o externalismo semântico de Putnam implica em um tipo de essencialismo que não descreve adequadamente a prática científica, já que as referências dos termos que designam espécies naturais seriam determinadas por características essenciais dos exemplares que compõem cada uma daquelas espécies. Essas essências seriam as verdadeiras responsáveis pela identidade das espécies naturais. Uma vez conhecidas tais essências, estaríamos aptos a identificar tais espécies em qualquer mundo possível, visto que suas essências permaneceriam estáveis mesmo diante de (...) mudanças nas descrições de outros de seus atributos. Logo, o externalismo semântico parece inadequado para explicar o desenvolvimento da ciência. Ademais, os critérios de identificação de espécies químicas e biológicas não são fixados da maneira proposta por Putnam. Este artigo apresenta essas objeções ao externalismo semântico de Putnam e formula uma resposta, afirmando que Putnam não postulou uma tese própria sobre critérios de identidade para espécies naturais. Sustenta-se que as menções de Putnam a postulados científicos são melhor compreendidas se interpretadas como elementos adicionais para a determinação das referências de termos que designam espécies naturais.Abstract:Some authors have argued that Putnam’s semantic externalism entails a kind of essentialism which does not describe scientific practice adequately, since the references of the terms that designate natural kinds would be determined by essential traits of the specimens which make up those natural kinds. Those essences would account for the identity of natural kinds. Once such essences are known, we would be able to identify natural kinds in anypossible world, since such essences would remain stable even in the face of abrupt changes in the descriptions of other kinds’ attributes. Therefore, semantic externalism seems inadequate for accounting the development of science. Furthermore, the identification criteria for chemical and biological species are not determined in the mannerproposed by Putnam. This paper presents those criticisms to Putnam’s semantic externalism and formulates a reply, stating that Putnam did not posit a thesis on identity criteria for natural kinds. His Putnam’ references to scientific postulates are better understood when interpreted as additional elements for the determination of thereferences of natural kind terms.Keywords: Essentialism; Reference; Necessity; Natural kinds; Meaning; Hilary Putnam. This paper faces the problem of the attribution of truth in a realistic sense to scientific knowledge. Arguments related to Hilary Putnam's notion of conceptual frame are considered. There is an absolute incompatibility between the existence of a conceptual background in science and the possibility of knowing a realistic, though partial truth, which has to be understood in relation to the conceptual frame.

Aggleton & Brown argue that a hippocampal-anterior thalamic system supports the “recollection” of contextual information about previous events, and that a separate perirhinal-medial dorsal thalamic system supports detection of stimulus “familiarity.” Although there is a growing body of human literature that is in agreement with these claims, when recollection and familiarity have been examined in amnesics using the process dissociation or the remember/know procedures, the results do not seem to provide consistent support. We reexamine these studies and describe the results (...) of an additional experiment using a receiver operating characteristic (ROC) technique. The results of the reanalysis and the ROC experiment are consistent with Aggleton & Brown's proposal. Patients with damage to both regions exhibit severe deficits in recollection and smaller, but consistent, deficits in familiarity. (shrink)
